New Delhi – The Supreme Court today dismissed a 26-week pregnant woman’s abortion plea. The Supreme Court dismissed the woman’s plea saying that the court cannot allow the termination of life. The petitioner woman is depressed and emotionally, financially and psychologically not in a position to take care of a third child and she has 2 previous children. Therefore, it was demanded in the petition that abortion should be allowed.
The woman is 26 weeks 5 days pregnant. If abortion is allowed, it will violate Sections 3 and 5 of the Medical Abortion Act. Karan, there is no danger to the mother’s life due to this pregnancy. Also, the baby in the womb is not deformed, said the Chief Justice of the Supreme Court DY Chandrachud. We cannot stop the heartbeat, he added.
What exactly is the case?
A 27-year-old woman with two children is pregnant for the third time. Her second child is not yet a year old. Therefore, the woman told the court through the petition that she is mentally, physically and financially unable to give birth to a third child. Therefore, she demanded that abortion should be allowed. She is currently 26 weeks pregnant and abortion is allowed only up to 24 weeks under the Medical Abortion Act. Abortion is allowed only if the fetus is in danger or the life of the pregnant woman is in danger or for any other medical reason.
